1. Agreement to Terms
By placing an order with Sydney Bio Packaging (‘SBP’, ‘we’, ‘us’, ‘our’) through sydneybiopackaging.com.au, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree, please do not proceed with your order.
2. Ordering & Pricing
2.1 Prices
All prices are in Australian dollars (AUD) and exclude GST and delivery charges unless stated otherwise. Prices are subject to change without notice. The price applicable to your order is the price displayed at the time of checkout.
2.2 Minimum Order Quantity
Our minimum order quantity is 500 cups per order. Orders below this quantity cannot be processed.
2.3 Quantity Tiers
Pricing is based on quantity tiers as shown on each product page. The price displayed at checkout is the total order price for the selected quantity, excluding GST.
2.4 GST
GST (10%) will be added to all orders at checkout. The final invoice will display the GST amount separately.
3. Production & Artwork
3.1 Artwork Supply
All custom printed cups require print-ready artwork to be supplied by the customer. Production will not commence until approved artwork has been received and confirmed by SBP.
Artwork must be supplied as:
- PDF, AI, or EPS format
- Minimum 300 DPI resolution
- CMYK colour mode
- Outlined fonts (no live text)
- Include 3mm bleed where applicable
SBP accepts no responsibility for print quality issues arising from artwork that does not meet these specifications.
3.2 Artwork Approval
A digital proof will be provided for your approval before production begins. Production commences only after written approval is received from the customer. Any changes requested after approval may incur additional charges and extend production time.
3.3 Colour Accuracy
Colours on screen may differ from printed output. SBP does not guarantee exact colour matching unless a physical press proof has been arranged and approved in advance. Minor variations in colour between production runs are considered acceptable and do not constitute a defect.
4. Production Time
4.1 Standard Production
Standard production time is 7-10 working days from the date of artwork approval. Working days exclude weekends and Australian public holidays.
4.2 Rush Orders
Rush orders are subject to a 35% surcharge on the standard order price and are subject to factory availability at the time of ordering.
Rush production time is 2-6 working days from the date of artwork approval. Rush orders are available for selection at checkout under ‘Production Time’. SBP will confirm rush availability by email within 24 hours of order placement.
If rush production cannot be fulfilled due to capacity constraints, SBP will notify the customer and offer the following options:
- Process the order at standard production time with a full refund of the rush surcharge
- Cancel the order for a full refund
SBP accepts no liability for losses arising from inability to fulfil a rush order.
4.3 Production Start
Production commences only after all of the following have been received:
- Confirmed order and payment
- Written artwork approval from the customer
- Rush availability confirmation (for rush orders)
5. Delivery
5.1 Delivery Charges
Delivery charges are calculated based on the weight, volume, and destination of the order and will be displayed at checkout before payment is made.
5.2 Delivery Timeframes
Delivery timeframes are estimates only and are not guaranteed. SBP will not be held liable for losses arising from delivery delays caused by third-party carriers, weather events, or other circumstances beyond our control.
5.3 Delivery Address
It is the customer’s responsibility to provide a correct and complete delivery address at the time of ordering. SBP accepts no liability for orders delivered to an incorrect address provided by the customer. Re-delivery charges may apply.
5.4 Risk & Title
Risk of loss or damage to goods passes to the customer upon dispatch from our facility. Title to the goods passes to the customer upon receipt of full payment.
6. Cancellation
6.1 Before Production
Orders may be cancelled without penalty up until artwork approval is given and production has commenced. Cancellation requests must be made in writing to our team via email.
6.2 After Production Commences
Once production has commenced, cancellation is not possible as the cups are custom printed to your specifications. No refund will be issued for orders cancelled after production has started.
6.3 After Dispatch
Orders that have been dispatched cannot be cancelled. Any return of dispatched goods will be treated under our Returns policy (see Section 7).
7. Returns & Refunds
7.1 Faulty or Incorrect Goods
If you receive goods that are faulty, damaged, or incorrectly printed (not matching your approved artwork), you must notify SBP within 48 hours of receipt with photographic evidence. SBP will, at its discretion:
- Replace the affected goods at no charge, or
- Issue a partial or full refund depending on the extent of the fault
7.2 Change of Mind Returns
All custom printed cups are manufactured specifically to your order and approved artwork. Change-of-mind returns are not accepted under any circumstances for custom printed products. Please ensure you are ordering the correct product, size, and quantity before approving your artwork and confirming your order.
For standard (non-custom) stock items only, a change-of-mind return may be accepted within 3 days of receipt, subject to all of the following conditions:
- The item is unused, unopened, and in its original re-sellable condition
- A 3% restocking and handling fee applies
- A $35.00 collection/return freight fee applies
- All return freight costs are the responsibility of the customer
Refunds for approved standard item returns will only be issued once goods are received, inspected, and confirmed to be in re-sellable condition by SBP.
7.3 Refund Method
Refunds will be issued using the same payment method as the original transaction. Credit/debit card refunds will be processed as a credit to the original card. Cheque or cash payments will be refunded by company cheque.
7.4 Discrepancies & Damage
Any discrepancies, shortages, or damage must be reported within 48 hours of receipt of goods. Claims made after this period may not be accepted.
8. Limitation of Liability
To the maximum extent permitted by Australian consumer law, SBP’s liability is limited to the value of the goods supplied. SBP will not be liable for any indirect, consequential, or special loss or damage, including but not limited to:
- Loss of revenue or profits
- Loss of business or opportunity
- Loss arising from production or delivery delays
- Loss arising from colour variations within acceptable print tolerances
Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by the Australian Consumer Law that cannot lawfully be excluded or limited.
9. Intellectual Property & Artwork
The customer warrants that all artwork, logos, and content supplied to SBP for printing are owned by or licensed to the customer, and that the use of such material does not infringe any third-party intellectual property rights. The customer indemnifies SBP against any claim arising from a breach of this warranty.
SBP retains the right to use images of completed orders for portfolio and marketing purposes unless the customer expressly opts out in writing at the time of ordering.
10. Privacy & Data
SBP collects and stores customer information solely for the purposes of processing orders and communicating with customers. We will never sell or share your personal or business information with third parties without your consent, except where required by law.
Our website uses secure payment gateways (PayPal and eWay) for all transactions. SBP does not store credit card details on its systems.
11. Website Use
All content on sydneybiopackaging.com.au, including text, images, graphics, and source code, is owned by or licensed to Sydney Bio Packaging. No content may be copied, reproduced, or distributed without prior written consent.
SBP endeavours to ensure all pricing and product information on the website is accurate. In the event of an error or omission, SBP reserves the right to correct the error and, where an order has been placed at an incorrect price, to cancel the order and issue a full refund.
12. Governing Law
These Terms and Conditions are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales.
